Hunter Biden, the son of U.S. President Joe Biden, has reached a tentative deal with the federal prosecutors in Delaware to plead guilty on three charges related to his tax and firearm violations, according to a court document filed on Tuesday . The charges include two counts of willful failure to pay federal income tax for 2017 and 2018, and one count of illegal possession of a firearm by a drug user in 2018 .
Under the proposed deal, Hunter Biden would acknowledge that his drug use was a contributing factor in his gun crime and enter into a pretrial diversion agreement, which would require him to remain drug-free and avoid committing additional crimes for two years. If he successfully completes the agreement, the gun charge would be dismissed. The deal also stipulates that he has fully repaid his back taxes and fines, totaling $2 million, with the help of a loan from his personal attorney .
The investigation was led by David Weiss, the U.S. Attorney for Delaware who was appointed by former President Donald Trump in 2018 and retained by President Biden to ensure the independence and integrity of the probe . The Justice Department has faced criticism from some Republican lawmakers who accused it of being biased and politicized against Trump and his allies, while being lenient and slow on the Biden family. A federal judge in Delaware must approve the plea deal before it becomes final. A hearing date has not been set yet.
